Terms of Service

Effective date: February 3, 2026 Last updated: February 3, 2026 These Terms of Service (“Terms”) govern access to and use of the websites, applications, and software services provided by Eval Hero LLC (“EvalHero,” “we,” “us,” or “our”). Customer-specific order forms, service agreements, data-processing terms, or other signed documents may contain additional or controlling terms.

1. The Services

EvalHero provides software for training, evaluations, taskbooks, forms, workflows, knowledge, approvals, signatures, analytics, and related organizational activities. Features may change as the product is improved. Material contractual commitments should be stated in the applicable signed agreement.

2. Eligibility and authority

Users must be legally able to accept these Terms and must have authority to act for an organization when creating or administering an organizational account.

3. Accounts and security

Users are responsible for protecting credentials, using accounts only as authorized, and promptly reporting suspected unauthorized access. Users must not share passwords or one-time codes.

4. Customer content

As between EvalHero and the customer, the customer retains its rights in content submitted to the Services. The customer grants EvalHero the limited rights necessary to host, process, transmit, secure, back up, and display that content to provide the Services and meet applicable obligations.

The customer is responsible for determining whether it has the authority to collect, upload, use, disclose, and retain the content placed in EvalHero.

5. Acceptable use

Users may not use the Services unlawfully; attempt unauthorized access; interfere with security or availability; upload malware; abuse communications; scrape or attack the Services; misrepresent identity or authority; or use the Services in a way that violates another person’s rights.

6. Third-party services

The Services may depend on or integrate with third-party providers. Third-party services may have separate terms, privacy practices, availability, and limitations.

7. SMS and operational messages

Users who affirmatively opt in may receive transactional messages related to authentication, onboarding, account activity, and pending work. Message frequency varies and message and data rates may apply. Consent is not a condition of purchase. Reply STOP to opt out of eligible non-OTP messages and HELP for assistance. SMS is not an emergency notification service.

8. Fees, term, and renewal

Subscription fees, user or personnel counts, billing cadence, implementation charges, renewal, non-renewal, suspension, and refund terms should be stated in the applicable order form or signed agreement. Do not rely on marketing-page pricing when a signed agreement states different terms.

9. Customer responsibilities

Customers are responsible for authorized administration, user access, content accuracy, legal and regulatory obligations, retention requirements, appropriate use of signatures and evaluations, and decisions made from the records maintained in the Services.

10. Suspension and termination

EvalHero may suspend access to protect the Services, address misuse, respond to legal requirements, or enforce payment and contractual obligations. Termination rights and data-return obligations should be governed by the applicable agreement.

11. Disclaimers

Except as stated in a signed agreement, the Services are provided on an “as is” and “as available” basis to the extent permitted by law. EvalHero does not provide legal, medical, employment, regulatory, accreditation, or public-safety operational advice.

12. Limitation of liability

Limitations, exclusions, and caps should be reviewed by qualified counsel and coordinated with customer agreements, insurance, governing law, and applicable public-sector requirements.

13. Confidentiality and data

Confidentiality, security, breach-notification, data-processing, deletion, and return obligations may be addressed in a separate signed agreement, security addendum, or data-processing addendum.

14. Governing law

The current working terms identify Texas law. Confirm the governing law, venue, and treatment of public-sector customers with counsel before publication.

15. Changes

We may update these Terms. Material changes will be communicated through an appropriate channel, and continued use may be subject to the updated Terms as permitted by law and contract.
